Announce legal action to hold accountable officials and technical support or authorize the destruction of the site of St. Stephen (02/12/2009)

"The Civic Platform for the Defence of the Archaeological Heritage of San Esteban has commissioned a team of lawyers association members preparing legal action aimed at investigating the potential liability in the courts against the alleged commission of crimes against property by officials of the Directorate General of Fine Arts and Cultural Heritage of the Ministry of Culture, as well as against its own Director General, Enrique Ujaldón, in the event that your personal signature endorse or authorize the removal of archaeological remains Murcia XIII century found during excavations at Jardin de San Esteban de la capital.

May perhaps destroy the site but must answer justice respond to the legality of their actions, which have opposed by most experts, both archaeologists and architects, and thousands of outraged citizens who attend the sad spectacle of seeing those charged by society to protect, conserve, rehabilitate and make available to the public its archaeological heritage are precisely those that, in the service of powerful economic and political interests, will allow, justify and implement a serious attack on our cultural and our historical heritage, using lies, misinformation, authoritarianism and disregard for citizens, consummating alleged crimes.

The Historical and Aqueológico has extensive legal protection from the Spanish Constitution (Articles 46, 148 and 149), which makes it a core value of our legal system, through state legislation on Equity (Spanish Historical Heritage Act 1985), and including the Statute of Autonomy and other regional laws, as well as European legislation, conventions and recommendations of the Council of Europe and ICOMOS (UNESCO).

All of them guarantee the legal protection of archaeological heritage and the prevention and prosecution of its destruction and pillage.

Is all this legal protection which would presumably be violated in many of its end and called into question the actions of the General Directorate of Fine Arts and Cultural Rights in its efforts to bring the site to the unavoidable goal and priority to facilitate municipal project construction of a parking in the basement of the old Garden of San Esteban.

The shameful performance of our regional and municipal public officials, which is part of a long tradition of assault and destruction of historical heritage of all Murcia, now against the main material legacy of the Murcia Islamic and medieval city, end up in court justice, a place which we are forced to go to the people asking the protection of our rights and defend the general interests threatened by those who should ensure their preservation.
