The Court of Auditors park again Abellán complaint against zoning agreements (12/06/2009)

The ruling also requires the payment of costs |

The Hall of Justice of the Trial Section of the Court of Auditors has rejected the appeal by the Socialist councilor Jose Manuel Abellán after he filed his complaint for alleged irregularities in various planning agreements entered into by the city of Murcia.

The Court also ruled that the appellant shall pay the costs of this process, the result of resource Abellán filed against the order of the court by which file is causing.

For the Court, "has so clear and evident, the absence of any assumption of responsibility and accountability" by the City of Murcia.

The room "does not find arguments to revoke the Order is now used, nor are the requirements of law and doctrine of this Court to find evidence of actual damages public funds of the Municipal Corporation."

The statement estimated that the complainant questioned the valuation of the land result of such agreements, which he received the City-based solely on a valuation provided by him, while the City Council questioned the reliability of the valuations of this company ( Arquitasa) and had appraisals performed by other companies set different values to it, and very similar.

Already in 2007 the court observed that there were no alleged accounting responsibilities, and in 2008 the Court of Auditors Adviser agreed not to initiate the refund procedure requested by Abellán, since it did not provide any documents proving that operations have taken place specific economic.
