Conclusions of the commission of inquiry into a test library assistant (15/10/2014)

On 1 September 2014 the Research Committee of the selection process for the creation of a waiting list of Library Assistant as provided by Decree Councillor Recruitment and Heritage August 4, 2014 is constituted.

The commission consists of Nuria Fuentes García-Lax, Councillor for Security and Human Resources as Chair, José Zapata Ros, representing the Municipal Group PSOE, Esther Herguedas Aparicio, representing the Municipal Group IU-Greens, Ruben Juan Alfonso Serna, on behalf of the Municipal Group UPyD, the Director of Personnel and the Director of the Office of the Municipal Government, Secretary of the Commission.

They have also attended as listeners to their request to the hearings that the Commission of Inquiry has made, a representative from each of the unions CCOO, UGT and SPLRM-ATABAM, having renounced the Personnel Board part of the Commission.

This Commission was created to clarify the possible leaks produced in that selection process, of which the local press in the days following the publication echoes, on 1 August, the qualifications of the tests performed, given account for the striking of the first three grades of exercise type test, by its distance from the next note, and giving the fact that these notes correspond to families of officers of the Library Service.

The research work of this Committee has focused on the investigation of possible leaks of multiple choice knowledge test on July 21.

However, the Commission of Inquiry has also learned of other possible incidents that have been reported by applicants of this call by instances within claims submitted for such purpose.

In this respect the Commission wishes to state that lacks legal powers to resolve complaints by applicants of this call, corresponding to the selection board study and resolution of these, being in the first instance the competent authority and the administrative procedure adequate to ensure the defense of the rights of the claimants.

The Commission of Inquiry to fulfill the purposes for which it is created, made a total of 36 individual interviews, 4, 11 and 23 September, requesting the voluntary appearance before the committee of members of the selection board of reviewers of the Court on the day of completion of the tests, successful applicants and suspended municipal officials and Library Services aspirants that are familiar.

The union section of SIME not appeared were also invited.

In this regard, the Commission wishes to thank all the contributions made to the research and the collaboration of all those who volunteered at the request of the Commission or at its request, have appeared before it and have testified.

To carry out its work and personal testimonies, this Commission has known various claims by applicants, and proceeded to study the documentation requested the Court and provided by it, relating to the minutes of the meetings of that body .

Throughout its work, the Commission was able to obtain an overview of the process, to gauge the views of the people involved from all perspectives, listen and gather complaints and, given the large number of opinions and views expressed, do an objective assessment of them.

As regards the central object of their work, assess the possible existence of leaks of type test selection process test, the Commission, in the framework of its powers and the means at its disposal, it has been found that the performance the Court, as a collegial body responsible for the design and conduct of the tests, and the people who attended that body in the work of copying and monitoring the examination, have taken all the necessary precautions in keeping the exercise, without which they have found no evidence of filtration.

Moreover the Commission, from the testimonies of different opponents and complaints, it has been known the existence of several incidents occurred in the day of the examination in relation to the test documentation, including identification of personal data, answers Test with pencil or pen, carrying it on the back of the evidence provided, etc.

From the testimony and documents presented it follows that these events have had a very timely basis and in most classrooms enabled 38 tests have been developed quite normally and without incident.

We have also known that some of these incidents were corrected by the Court which, on the day of the call, refereed the means to suppress evidence of personal data and subsequently corrected the tests regardless of its performance in pencil or pen and on the back of the exam or not.

Thus, given the limited window of incidents and appreciated the difficulties brought about the realization of a massive test, the Commission considers that, while it is desirable that such incidents would not have occurred, overall the test was properly performed.

In any case, the Commission considers to be taken into account the incidents and current experience should serve to improve procedures in future selection processes, which will prepare a report on them.

The Commission recalls that the development of the findings of their work can only be based on provable facts, leaving out impressions or subjective assessments.

Therefore, and being familiar with that there are reasonable doubts about the performance of the test in many sectors, we have also taken into account the various interests at stake: the opponents that have passed the test and have the right to be respected their rights, the Court and staff who have worked in the test that is right for their work and honor and respect for opponents who have filed claims entitled to may be addressed and resolved.

Considering all these interests and taking into account the absence of evidence demonstrating the existence of a leak the contents of multiple-choice test, the Commission of Inquiry

RESOLVED:

The Qualifying Court should continue the selection process as provided in the call to end the selection.
