Final Approval of Ordinance to allow you to get a business license and works in the act (17/02/2012)

Murcia City Council approves the new Municipal Ordinance on Administrative Simplification Measures in the Field of Implementation and Enforcement of Construction Activities, with the aim of reducing red tape and streamline the licensing process.

With the new rules leave replaces previous communication activities and works, so that authorization is obtained on the spot.

The government team works with the aim of making the Local Administration an ally and partner of entrepreneurs and small businesses who want to develop their business ideas in the municipality, providing the processing.

One of the first steps is to reduce red tape and the steps that employers must meet, not detracts from the transparency and rigor in the procedures.

The City Council approved the Municipal Ordinance on Administrative Simplification Measures in the Field of Implementation and Enforcement of Construction Activities, to be ratified by Parliament next week.

Thus, the licenses of all works and activities without risk to people, things or the environment may be processed from now faster and equally safe.

This legislation also provides for the establishment of the Office of Licensing, created with the purpose of promoting the opening of businesses and companies in the municipality.

The new ordinance will take effect in 15 days from its publication in the BORM.

The standard incorporates and expands the activities that were regulated by a previous ordinance adopted in 2009 which came into force in March 2010, in which the City Council adopted a series of measures simplifying the administrative procedures for the initiation of activities.

A new feature was then introduced to replace the requirement for a single license holder prior notice for certain activities exempt from environmental assessment.

The new text replaces the previous communications authorizations and statements by officials in cases where the law allows, according to its innocuous nature, its limited impact on the environment and urban management.

Thus, the act of communication will be entitled to initiate the activity.

In which not the case and it is essential to grant the authorization, rationalization measures are introduced, time reduction, simplification or elimination of paperwork documentation requirements.

Thus, activities that can begin to function without needing ALS are:

- Necessary for the farm, but agro-food processing industries

- The non-commercial or industrial bodies that are holders of Public Administration

- Centers for religious worship

- Professional activities

- Offices, warehouses or premises owned by nonprofit entities that do not perform activities of a commercial or industrial

- The scheme subject to prior notification.

- Those that are expressly exempted from the obligation to obtain operating license by the law applicable to them

The new ordinance states that sufficient advance notice to the City, within seven days to:

- Initiate activities exempt from environmental qualification if they meet certain conditions: not specify the execution of works, that the use is consistent with the planning and ordinances that do not work at night, do not have musical installation and that the building is not subject to any system of protection in terms of historical and artistic heritage.

- Change the ownership of the licenses that does not require modification or extension.

- Communication prior to the commencement and operation of activities that had previously obtained a license to operate subject to environmental assessment.

The elimination of red tape is also applied to the planning permission for which establishes three procedures for authorizations: standard (for which required technical project), simplified general (need technical direction) and special simplified (no details of either project or technical direction).
