Updated Environmental Protection Ordinance of the Atmosphere to reduce pollution and improve air quality (21/02/2011)

The text has been agreed with the FREMM and the College of Industrial Engineers.

Mayor House noted that the ordinance regulates the emerging technological advances and incorporates the new rules on the matter.

Among the issues it covers include the height of chimneys, out of air or visual impact.

For cleaner air, less pollution and an increase in quality of life.

This is the objective it set itself the Department of Environment and Urban Quality when it addressed the update of the Ordinance on the Protection of the Atmosphere, approved in May 2006.

The reform of legal text and was indispensable to the technical advances in this area experienced in recent years.

This morning, Mayor, Miguel Ángel Cámara, accompanied by the head of the Environment, Adela Martinez-Cacho, unveiled the new legal text.

Mayor House has stressed that the reform of the ordinance provides for improved protection of the municipality in those situations that may create a risk of air pollution, while allowing the development of economic activities, adapting to new regulations existing as well as situations arising from the emergence of new technologies and resources.

The interest and participation in drafting the text of the Regional Federation of Employers of the Metal de Murcia (FREMM) and the College of Industrial Engineers of the Region of Murcia, ensure technical feasibility and acceptance by the various sectors involved in protection of air quality in the municipality.

The text produced is the result of consensus with stakeholders on the matter and clear reflection of real interest and commitment of all to comply with environmental regulations and the protection of air quality, while allowing the development of activities economic in the municipality.

Result of consensus

In February 2010, the Association of Industrial Engineers of the Murcia Region and the Regional Federation of Employers of the Metal de Murcia (FREMM), requested the City of Murcia, through the Department of Environment and Urban Quality, the specific articles of the ordinance, based on the experience gained during the years of application of the same, technical advances have emerged since the advent of new legislation on the matter.

Studied the proposals made, and after several meetings with both groups indicated, which were grateful for the high interest shown, as with the municipal engineers involved, it has developed the new Atmosphere Ordinance as presented.

The most notable are:

Distinction of gases: When deciding the measures to be taken for the evacuation of gases from combustion sources of distinction is made between those generated in homes, local produced in hosting activities, more likely to generate discomfort both nearby dwellings and users of public roads.

For the first maintaining the conditions set by the Technical Building Code, while for those from activities should be made by independent chimneys and exclusive watertight, establishing greater distances than in the previous case from the vent to air inlets properties outside the activity.

2.

Stack height, the rule governing the height of the chimneys from activities with respect to living quarters and common step of the buildings housing (terraces, galleries, drying area, etc..) Should rise from the ground, at least 3 meters.

Air vents also review the level of the local air vents in front with respect to the sidewalk, which happens to be from 3 to 2.20 meters.

Less visual impact: The ordinance also introduces new criteria to avoid the visual impact that could generate the installation of fireplaces, both in height and when specifying a path Crane, in this case should be harmonized with it, or in the case of historic or listed buildings.

5.

Documentation and adaptation to standards: It introduces an obligation to provide new technical documentation in the business license application that ensures the absence of discomfort to the environment.

It includes adapting to new rules developed, among which include the Technical Building Code, the Law 34/2007 of air quality and atmospheric protection, Royal Decree 100/2011, which updates the list of potential activities polluting the atmosphere, the Royal Decree 1027/2007 approving the Regulation of Thermal Installations in Buildings (RITE) and the Law 4 / 2009, Integrated Environmental Protection of the Autonomous Community of Murcia.
