The Governing Board approved the draft amendment to the Ordinance Regulating Street Vending The personal and not transferable and the validity of the authorizations until a period of two years are the new features included in municipal law (17/11/2010)

The Governing Board of the City of Murcia has given the green light this morning on proposed changes to the Municipal Regulatory Street Vending in the city.

The amendments will experience the Ordinance to comply with the mandate of the European Directive 2006/123/EC of the European Parliament and Council of 12/12/2006, on the internal market in services and in accordance with the provisions of Law 17/2009 of 23 November, on free access to activities and exercising, are:

1 .- The personal and nontransferable licenses.

2 .- A maximum duration of authorization for sale in markets for 2 years, such period shall be considered sufficient to amortize the investment and remuneration of capital invested.

Regarding the possible transfer of licenses, the need for adaptation is because the state legislature finally decided to establish its transmissibility, suffice to that effect after notifying the competent authority

With respect to the maximum term of authorizations, the First Transitional Provision of Law 1 / 2010, reform of LOCM has stated that "the authorization for the exercise of hawking granted before the entry into force of this Act shall be automatically extended.

However, these authorizations may not extend its duration beyond the limits of validity laid down by the competent public authorities in their respective territories, in accordance with paragraph 7 of article one of this Act This period is counted from the entry into force development of regulations and enforcement of this Act "

Well, in relation to this automatic extension of permits issued, worth noting that in the Autonomous Community of Murcia there is currently no regulation in this regard, although there is evidence that the Ministry of Commerce is working on its development , so therefore, without prejudice to the possible adoption of regional legislation governing this matter, the truth is that this Administration under the provisions of the transitional arrangement of the Law 1 / 2010, amending the LOCM, holds the skills needed to design the appropriate transitional arrangements regarding the automatic extension of permits issued before the entry into force of the new rules apply.

In this sense it has considered, in agreement with the Directorate General for Trade of the CARM and the different associations affected by this legislation, which initially established within 2 years is insufficient for the repayment of capital invested in the activity as following the grant of a permit, resulting therefore in the public interest to proceed with the extension of that period to 4 years.
