The City Council transfers the management contract of the JC1 sports complex to the company proposed by the insolvency administration (04/04/2018)

The new adjudicataria will keep the sports program in its entirety, both in activities and in the price, and the Department of Sports and Health assumes the direct management of the paddle courts.

The entire administrative process has been supervised by the municipal technicians and has been processed as established by the Commercial Judge.

The Government Board today approved the cession of the sports complex contract in Juan Carlos I to the company Concesiones Administrativas del Mediterráneo SL, in response to the petition presented to the City Council by the insolvency liquidation administrators.

The document was registered on January 25 and based the request 'having accepted the offer submitted by that company in the liquidation phase of the tender' of the previous contractor, Infraestructuras Terrestres SA On January 31 a new document indicated also the acceptance of said offer by the creditors with privileged credits.

The new concessionaire will maintain the sports program in its entirety, both in activities and in the price of the same, except in the paddle courts adjacent to the sports pavilion of Espinardo, which were proposed as an improvement, given the decision of the Department of Sports and Health to directly take over their exploitation.

In this regard, the insolvency administration must submit before April 7 the documentation of the liquidation of the paddle school, with the return of the amounts to the affected users.

The building destined to a social center, which includes a nursery school, and whose construction was also presented by Intersa as an improvement of its offer, is also excluded from the subrogation.

On the other hand, as established by the legislation for the subrogation of contracts in a bankruptcy proceeding, the company that will take over the contract has submitted the required documentation:

- Express request before the contracting authority for the transfer of the administrative contract made by both the Insolvency Administration and the commercial Concesiones Administrativas del Mediterráneo, SL

- Original payment letter of having constituted a definitive guarantee for the amount of 218,000 euros for the management of the service prior to the authorization of assignment of the requested contract.

- Responsible declaration signed by the commercial Concesiones Administrativas del Mediterráneo, SL of subrogation in all rights and obligations deriving from the reference contract in accordance with the legislation of contracts, as well as the rest of the municipal documents and agreements that govern it, and present obligations and future derived from them.

The entire administrative process has been supervised by the municipal technicians and has been processed as established by the Commercial Judge.
