The streets with the highest concentration of entertainment venues must comply with corrective measures (09/02/2018)

The Governing Board has approved three Special Acoustic Protection Areas on roads where acoustic quality objectives are exceeded.

Navarro: "We want to promote our city model that corresponds to more livable districts and districts, which guarantee the protection of the right to local rest in the face of noise, combining leisure and hospitality activities with the well-being of citizens".

The measures, defined after the contributions of the Sectorial Council of Noise, include the reduction of tables, the implantation of acoustic meters or the limitation in the opening of new leisure facilities that suppose an increase in the number of establishments in the area.

The City Council of Murcia continues adopting measures to improve the quality of life in neighborhoods and districts, where a key factor for citizen welfare is represented by the usual noise level.

This morning there has been significant progress with the initial approval by the Governing Board of the declaration of the Special Acoustic Protection Zones (ZPAE) in Murcia Centro, its delimitation and the Zonal Plans with the measures applicable to them.

These are streets where the acoustic quality objectives are exceeded and it is, therefore, necessary to establish corrective measures (zonal plans) aimed at achieving their fulfillment, thus achieving compatibility, in this case, leisure with the quality of life of the children. residents of the areas where they are concentrated.

"We want to continue developing our city model that corresponds to more livable neighborhoods and districts, which guarantee the protection of the right to local rest in the face of noise, improving accessibility for people with reduced mobility and other pedestrians, and making the leisure, hospitality and catering with the well-being of citizens ", explained Antonio Navarro, councilor for Urban Planning, Environment and Garden.

For this, "we are committed to ensuring that noise does not constitute a problem that prevents Murcians from enjoying their city," added Navarro.

The City Council already had protection zones included in the 2000 ordinance, but now it was necessary to adapt them to the variations produced in the spatial distribution of premises in these years.

To this end, a map of leisure noise in the city has been drawn up, for which 3,600 measurements were made in areas with a higher concentration of entertainment venues.

Citizen participation

In addition, the contributions presented by the members of the Sectorial Council of Noise, conceived as a collegiate body for citizen participation in the field of protection of the environment and people against noise, constituted in 2016, have been incorporated.

Once all the data have been analyzed, and with the aim of achieving a progressive reduction in sound levels, three ZPAE have been delimited in the urban center: Universidad-Alfonso X;

San Lorenzo, Santa Eulalia and San Juan;

San Pedro, Santa Catalina and Plaza de las Flores.

In general, for the three zones, measures are established that include the implementation of acoustic meters, in order to have continuous noise measurements and to know their evolution, as well as to intensify the environmental inspection and control by the Local Police of the noise pollution and opening and closing times of premises and terraces, as well as the number of authorized tables, chairs and tables.

Licenses will not be granted for the opening of new leisure venues that involve an increase in the number of nightclubs, discos, tablaos, authorized venues for live performances, pubs, bars with music or piped music or TV sets, restaurants with music or with musical thread or TV sets, and other activities that are considered similar to the previous ones, by time and activity.

However, the reform of the premises will be allowed, without this being considered a substantial change to environmental effects when this will result in improvements of an environmental nature, better isolation of the premises or suppose to avoid the concentration of people abroad.

Phases, schedules and streets

The implementation of measures will be carried out in two phases.

In the first one, provisions are established according to the morning, afternoon and evening schedule, and while some are general for the three zones, others are specific for certain streets.

Thus, in general and throughout the day prohibits: the circulation of charangas or parades, except those duly authorized on the occasion of popular or traditional festivities;

the bars in the street (restricted to the authorizations for Christmas Eve, New Year's Eve, Bando de la Huerta and Burial of the Sardine);

the installation of vending machines on public roads;

and the consumption and expedition of drinks in the street and the stay of clients abroad, outside the terraces.

The new authorizations for terraces will be conditioned to not increase the number of tables, tables and chairs and the locals must put on their facades identification signs of Special Acoustic Protection Zone, where attitudes and measures to be adopted by customers are collected.

The use of the terraces will be allowed from 9 in the morning until 00:30 and the installation of street vendors (churros, waffles, etc.) at night will not be authorized.

Specifically, in Plaza de la Universidad outdoor activities are reduced and always during the day or afternoon and not coinciding with the school day.

In Enrique Villar with Puerta Nueva, Saavedra Fajardo, at the height of the Plaza Beato Hibernón, and C / Rambla, as well as the alley next to the Rincón de Pepe car park, authorized tables are reduced by 25% in the afternoon and evening.

The same decrease will occur in the Plaza de la Universidad, San Martin de Porres and Jacobo de las Leyes, during the night.

In a second phase, if in the period of 1 year from its application, the measures indicated have not brought about acoustic improvement in the area, other specific measures will be adopted in the streets where the minimum reduction of 50 has not been reached. % of exceeding the acoustic quality objectives.

In those cases, new reductions of 25% will be applied in the streets with the highest concentration of premises.

The agreement adopted today by the Governing Board represents the initial approval of the ZPAE, which will be published in the BORM, opening a period of 30 days of public information and final approval.

The maximum processing time is 6 months.
