Agreement between the families of Beniaján evicted for cracks in their buildings and Emuasa for the payment of compensation (05/12/2017)

The six families of the Jofi II building, which will be demolished, will receive an indemnity amount of 599,000 euros;

while the seven families of Monteazahar, which will be rehabilitated, will obtain 607,000 euros.

Emuasa's insurance company will compensate the Jofi II and Monteazahar owners' communities with 1,250,000 euros, evicted for cracks in their respective buildings since August 2014, after having reached and signed today a satisfactory agreement between both parties that rules out the litigation administrative, which ensures and speeds up the collection of amounts agreed to the 13 families of neighbors.

For the six families of the Jofi II building, the amount of compensation has been set at 599,000 euros, after the evaluation of the project and execution of the demolition of the property, while for the seven of the Monteazahar building it is 607,000 euros, after the evaluation of the project rehabilitation of it.

For its part, the City Council is committed to streamlining the administrative procedures to issue the work license for the demolition of the Jofi II building -whose solar will be owned by the Community of Owners- and the rehabilitation of Monteazahar.

The mayor of Murcia, José Ballesta, said that "this agreement allows these 13 families can, at last, turn the page of this traumatic experience that supposed the eviction of their homes for more than three years, and begin a new chapter of their lives , obtaining an economic and moral compensation that corresponds to them in justice ".

Emuasa took charge of the payment of the rents before the rehousing of the neighbors, something that is also recorded in the agreement signed today, which establishes that the families that had to vacate the Jofi II are entitled to compensation for the payment of the rent of the rehousing until the present month of December, while those of Monteazahar will receive said payment until the month of July 2018.

Chronology of events

In August 2014 the residents of both buildings, located in the Nieves Viudes Romero Street in Beniaján, were alarmed by the noises and cracks that occurred in both buildings.

After bringing the facts to the attention of the competent authorities (Fire and Local Police), it was found that both buildings were affected and Urbanismo decreed the eviction as a preventive measure.

Emuasa verified a fault in the water supply that supplies both buildings and proceeded to its immediate repair.

Appropriate measures were taken to secure the buildings, by injecting concrete, achieving its stability.

The neighbors filed a claim for Patrimonial Responsibility before the City of Murcia and a contentious-administrative appeal was filed before the Courts of Murcia, which is currently suspended at the request of those affected.

The Consistory, after the prescriptive opinion of the Legal Council of the Region of Murcia, attributes the responsibility to the company Emuasa.

After the negotiation with the affected families, an initial agreement was reached that has materialized today in the signing of a definitive agreement between both parties.
