Stability for agricultural workers with the fixed-discontinuous contract (24/05/2017)

The UCAM-Santander Chair of Entrepreneurship in the Agricultural Sector organized yesterday the technical day "The contract of fixed-discontinuous work for agricultural workers", which was attended by one of the main promoters of this legal figure, Mr. Antonio Checa de Andrew.

Given the situation of instability and labor insecurity in the agricultural sector between the 80s and 90s, the figure of the fixed-discontinuous worker arises with the intention of guaranteeing and protecting the labor rights of farm workers.

In this process was the figure of D. Antonio Checa de Andrés, legal labor counsel attached to Iltre.

Bar Association of Murcia and academic number of the Royal Academy of Law and Jurisprudence of Murcia.

In 1990 the Supreme Court validated this type of contract to which, at the moment, "more than 40,000 agricultural workers of the Region are subject" emphasized Checa.

Direct link between worker and employer

The fixed-discontinuous contract for agricultural workers has a system of appeal and cessation different from that of other sectors.

"Irrespective of their seniority, the work is distributed jointly, with a difference of 15 days worked. In this way, there is a direct and permanent link between the worker and the employer that generates stability in the employment relationship" explained the rapporteur during the chat.

Antonio Checa is a renowned labor lawyer from Murcia.

He has participated in more than 15,000 trials throughout his career and in 2013 received the Cross of the Order of St. Raimundo de Peñafort in recognition of a long professional career.

It also has the Medal of Merit to the Service to the Law, granted by the General Council of the Spanish Law.

The conference, held in the Hall of Acts of the Jeronimos Monastery of the Catholic University and within the framework of actions programmed by the UCAM-Santander Chair of Entrepreneurship in the Agro-Food Sector, attended more than 70 guests among sector entrepreneurs, lawyers Labor, representatives of agrarian associations and trade unions.
