The City Council considers impossible to comply with the Supreme Court ruling on the budget that should handle municipal boards (19/07/2016)

The ruling refers to the 2014 accounts, which have been executed and settled.

If districts must have 8% of the municipal budget, council members would have no capacity to decide on any work of general interest, since they lacked funds to carry them out.

City Council legal services have not been informed to date of the judgment of the Chamber for Contentious on an appeal by the president of the Municipal Board of Sucina on the availability of public funds by the districts.

In principle, some discrepancies will lead the Chamber to issue some clarifications, especially appreciated in two ways:

On the one hand, the judgment follows that there must be a breakdown between direct and indirect resources to determine the 8% rule on which correspond to the joints.

The ruling says that the distinction is not detailed enough.

Moreover, the judgment provides that no appeal, but legal services disagree to understand that it is possible to file an appeal to the Supreme because, although the Regulation of Citizen Participation is a municipal rule, the Basic Law Local Government itself is a general regulation which opens the way to appeal to the Supreme Court.

Regarding the reference to the obligation to comply with the transfer of 8% of the budget to the boards, it is impossible to fulfill because there is some accounts already executed and settled.

Moreover, the House has already approved begin the process of amending the Regulation of Citizen Participation because they had found that compliance was difficult sections, besides requiring adaptation to neighborhoods and districts.

Also, strict implementation of the judgment, yielding 8% of each budget to the municipal boards would mean that the capacity of the entire City Council would be determined entirely by the presidents of neighborhoods and districts and not by the councilors of the Corporation elected by the citizens.

Thus, there would be performances and general works for the municipality that would be impossible to implement due to lack of economic availability.
