CCOO denounces the violation of the fundamental right to freedom of association by the Murcia City Council (06/09/2020)

On September 2, the head of Infant Schools in the Executive of the Union Section of CC.OO in the Murcia City Council, which represents our union in the General Negotiation Table when matters relating to its collective are discussed, has suffered retaliation for defending the interests of their colleagues and not having an attitude of submission to the head of the Nursery School Service.In what we understand as a clear and very serious attack on freedom of association and the right to collective bargaining, unprecedented so far in our City Council, this comrade has been the only one of the seven people who run the Infant Schools that has not been seen renewed in her position as director of the Infant School.Although the head of service tries to disguise this non-renewal by accusing the worker of "putting sticks in the wheels", the reality is that this colleague, who had already been suffering threats from the head of service for opposing the change in working hours that has been imposed by it, has an impeccable record, no complaint has ever been received about its performance and has the support of all the classmates of the nursery school that it has directed (who, in fact, have directed a complaint letter to the City Council) for which we understand that his dismissal is due solely and exclusively to a vendetta for his union activity (consisting of trying to provide improvements for the operation of the service and for the group of workers of this group in successive Negotiating Tables),lacking such punishment of any objective motivation.Although we have tried to make the Councilor responsible for human resources see the seriousness of this attack, to date we have not received any response from him and it seems that this process of cessation ("no renewal" in the words of the person in charge service) keep going.Neither Comisiones Obreras nor any other union can allow workers who take a step forward to defend the rights of their colleagues and their personal interests are harmed by this union activity, for which we are forced to report before public opinion and before the courts this serious attack not only on the partner but also on freedom of association and the right to collective bargaining.At CCOO we understand that this does not only attack the affected colleague and our union, but each and every one of the municipal employees, who thus see their right to collective bargaining diminished since it is clearly a warning for that nobody dares to confront the positions defended by the government team at a general negotiating table.On the other hand, the Murcia City Council, in the midst of the COVID-19 crisis, in our reckless judgment, is allowed to change the address of two of the seven nursery schools by putting the Infant School of Santiago el Mayor in charge of the Until now, director of the Sangonera la Verde Nursery School, we have no doubt that she is a great professional, but does not know the staff or the spaces of the nursery school to which she is going to be transferred, and putting in charge from the Sangonera la Verde Nursery School to a teacher, without any doubt a magnificent professional, but without experience so far in directing a Nursery School.Contrary to what has been done so far, instead of asking for volunteers at the Santiago el Mayor Nursery School to occupy the position of director, a colleague from another nursery school has been transferred (in which, according to our information Volunteers have not been requested either) using the figure of transfer "due to service needs" with which the organizational problem that involves a change in management two days before the start of the course and in the midst of the crisis due to the Covid-19 pandemic has extended to two nursery schools It is for all this that we ask the Murcia City Council for the restitution of the head of EEII.in the CCOO Union Section in the position of director of the Infant School of Santiago el Mayor and the dismissal of the Head of the Nursery School Service as the first person responsible for this violation of workers' rights and for putting their attitude at risk The normal operation of two nursery schools is irresponsible at a time as delicate as the one we are going through.
