The SIME submits more than 600 claims of fixation for interim and labor personnel in the region (25/09/2019)

The SIME Public Employees Union has already submitted more than 600 claims from workers from different Local Administrations, as well as from the Regional Administration and SEPE.

These claims are intended to ensure that the interim and labor staff working for years in the Administration (both continuously and chaining various contracts) achieve stability in their workplace, so that such hiring becomes fixed without returning to pass a new selection process.

The claim is based on the demonstration that there has been a significant abuse in the temporary nature of these workers, an issue that since Brussels has already called attention to the governments of our country precisely for abusing this temporality.

The European Parliament has already approved a resolution urging the member states of the European Community to comply with a directive that comes from 1999 and which refers to the fixation of workers as a sanctioning effect for abusing successive temporary hiring.

It is also possible that public employees who are in this situation of temporary employment, know before the end of this year if European justice recognizes their transformation into permanent staff of the Administration staff, as a sanctioning measure for abuse all kinds of temporary hiring to fill positions that are considered stable and structured.

This judicial decision will foreseeably come with a ruling motivated by two questions referred to the Court of Justice of the European Union CJEU by two Administrative Courts of Madrid.

In this regard, from the SIME, both from its own Legal Services, and through a collaboration and technical assistance agreement with the lawyer of the state on leave Javier Araúz de Robles, more than 600 claims of fixedness have already been processed.

These claims come from municipal workers such as Murcia, Cartagena, San Pedro del Pinatar, Torre Pacheco, San Javier, Molina de Segura, etc.

as well as personnel from the different Autonomous Community Councils, such as Education and Culture, Presidency and Finance, Murcia Health Service, University of Murcia, as well as personnel from the Ministry of Labor, Migration and Social Security in Murcia.

It is noteworthy to report that a significant percentage of the more than 600 claims submitted by the SIME have been processed through the Javier Araúz Office.

This lawyer already accumulates more than 6,000 claims of fixation at national level so that letters are taken before the public employment offers are called.

It is also important to note that according to calculations of the SIME Union, there may be a number of around 24,000 affected workers in the Region, so the number of claims that will finally be submitted by the Union is growing day by day, with the forecast that there are more than 1,000 claims that the Union finally files.
