The Supreme Court confirms the validity of the fire department oppositions (22/09/2019)

This is the completion and qualification of the third exercise of these tests, convened by the City of Murcia included in the Public Employment Offer

The 2nd Administrative Dispute Chamber of the Superior Court of Justice of Murcia has issued a ruling that dismisses the appeal filed against the judgment of the Contentious-Administrative Court No. 6 of Murcia of July 6, 2018, which dismissed the claim of several applicants for selective tests for access to 30 fire stations, convened by the City of Murcia, regarding the completion and qualifications of the third exercise of said selective tests.

In this way, the Chamber confirms at all its points what was dictated by the Contentious-Administrative Court, dismissing the claims against the qualifications of the third exercise that consisted of four tests related to: 1st Vertigo and balance;

2nd Claustrophobia;

3rd Combined Test and 4th Tools.

Likewise, it finally indicates that "the decisions taken by the Court in order to interpret / integrate the bases were adjusted to the meaning and purpose of these, were applied to all applicants equally and cannot be classified as arbitrary, irrational or disproportionate."

In short, the Chamber dismisses the appeal filed and fully confirms the judgment of the Contentious-Administrative Court No. 6 that dismissed the claims against the development and the qualifications of the third exercise of the opposition for access to the 30 firefighter positions in Murcia City Council, included in the Public Employment Offer.

In addition, it assesses the appropriate performance of the Qualifying Court, in each of the tests subject to challenge, resolving all the incidents that were raised, trying to harmonize the principles of confidentiality of the applicants and also the transparency of the selective process in each of the tests, which initially featured more than 2,000 applicants.

Finally, the judgment of September 12, 2019 orders appellants to pay the costs.

This resource originated during a time the paralysis of the opposition tests, which caused a considerable delay.
