Let's change Murcia asks the Plenary that the City Council supervises the Emuasa accounts and not the private part (24/02/2019)

The spokesman of the municipal group of Cambiemos Murcia, Nacho Tornel, will propose in the Plenary next Thursday that it is the City Council, as majority shareholder of Emuasa, who carries out the task of auditing the accounts of this entity, and not the private party, Hidrogea .

Tornel explained that, although the control function of the Emuasa accounts belongs to the Consistory through the municipal intervention service, it is Hidrogea who for years has been proposing the auditing company and assumes the contracting and contract amount of this action.

There are several legal texts in this regard, as is the case of the Basic Statute for Public Employees, which in its second additional provision states that among the public functions of local corporations is "the control and internal control of economic-financial management and budgetary, and accounting, treasury and collection ".

The rewritten text of the Law on the Regulation of Local Taxes, in its article 213, also refers to the fact that the municipalities are in charge of internal control over their economic management, of the autonomous agencies and dependent mercantile companies, "including the audit of accounts of the entities that are determined by regulation ".

The same text also indicates that financial control will be carried out by auditing procedures in accordance with public sector standards, and ensures full independence of the officials in charge of the intervening function.

Lack of material and human means

Tornel has indicated that the government team has to increase the number of human resources and technical resources to fulfill its audit function on Emuasa or, at least, assume the hiring of an external company to do so "through direct directives" of the municipal intervention service.

This would comply with what the Court of Auditors said in 2009 in relation to the possibility that local entities that, due to their limited economic and management capacity, may have difficulties in carrying out internal control functions, may sign audit contracts whenever the make through the aforementioned service.
