Murcia now points out several irregularities in Oliver's mill intervention proposal (18/02/2019)

-The municipal group Now Murcia presents its suggestions to the Basic Project of adaptation of the old Mill of Oliver, in the hamlet of Murcia Aljucer

-The municipal training has remitted to the councilor of Urbanism their contributions in relation to the project promoted by the Board of Landowners and the City of Murcia, to comply with current legislation

-Now Murcia has pointed out the contradictions that include the documentation of the project, as well as the legal impossibility of going ahead in its current conditions, since it does not fulfill the obligation of RECONSTRUCTION imposed by Urbanism in its day

-The PGOU indicates since 2001 the obligation to "RECOVER FOR EQUIPMENT THE MILL", and the current sanction, pending compliance, must be complied with the criminal sentence by the shield, and the current characteristics of the project are contrary to them and current urban regulations, since A PERGOLA IS NOT AN EQUIPMENT nor is it an effective and useful space for citizens

Now Murcia has submitted to the City of Murcia a statement of allegations to the Basic Project of Adaptation to the Old Mill of Oliver, recovery of the heraldic shield and landscape treatment of their environment, promoted by the MEETING OF HACENDADOS, where this Municipal Group analyzes in detail the irregularities collected in the same and that determine the legal impossibility of which it is executed in the proposed terms, when violating with it so much the city-planning norm as judicial and administrative resolutions as well as agreements of the Plenary of obligatory fulfillment

Among the regulations that violate the project is the General Plan of Urban Planning of the municipality of Murcia, the Land Law of the Region of Murcia, as well as the Decree of March 4, 2010 relapsed in the file of urban discipline followed by the City Council that required the RECONSTRUCTION of the parts of the demolished Mill, the Criminal Judgment of the Criminal Court number 12/6/2014 that obliged the BOARD OF HACENDERS, -for which a criminal sanction was imposed, an administrative and a order of restoration consisting of the obligation to restore and replace the existing heraldic shield in the Mill, as well as the reconstruction of the demolished parts of the Mill, and the motion of the Plenary of the Hon.

City of Murcia, of 12/21/2017, adopted unanimously.

In the brief presented by Ahora Murcia, it is evident that the Project is based on an uncertain and interested consideration, which is to affirm that the Oliver Mill was demolished in 2008, when the reality is that the only thing demolished by the BOARD DE HACENDADOS, was the "casal del Molino" remaining today the fundamental part of that construction on foot, among which is the milling infrastructure composed of tajamares and water splitters conduction channels, channeling and acceleration of courses of water and the ravines.

In fact, the Basic Project itself is in contradiction because, in some sections, it maintains that the mill was demolished and in others, it is recognized that the elements of the milling infrastructure are conserved in good condition.

The municipal training has carried out a complete study of the aforementioned Project, which states that its purpose is to act on a field of 1,304 meters, of which only 104 correspond to the construction of the Mill, the rest being a performance on its environment.

This action is contrary to the Murcia PGOU, because both the mill and its surroundings are part of an urban development to be developed through a detailed study called UD-Ac3, whose goal is precisely to recover the equipment for the mill and order a large green space AROUND IT.

In this case, it must be the urban developers who execute and pay for the works of that area qualified as a Green Space within the UD-Ac3 according to the Land Law.

Therefore, the Municipal Group emphasizes that a project can not be approved that intends to execute something that corresponds to the development planning of the PGOU, and less to claim that it was paid for with public money.

And, in the case of the Mill, in addition, there are several resolutions where the BOARD OF HACENDERS is ordered, undisputed responsible for the demolition of part of it, which undertakes its RECONSTRUCTION.

For Now Murcia, the cost of the works that contemplates the project in question is not trivial, when ascending to the amount of 406.627 euros.

Of all the intervention proposed in the project to execute, only 59,000 euros correspond to the action in the Mill, where instead of rebuilding Oliver's Mill, it is contemplated to place "A metallic structure that will shape its outline as a pergola, creating a covering element that provides shade in the space that previously occupied the mill, using wooden boards fixed to the metal structure, with different widths and separations, allowing the passage of light through them ".

Placing this pergola would violate the General Plan, because the PGOU of Murcia establishes that the Mill must be destined to be a Local Equipment, and that is precisely the objective of the UD-Ac3.

From this training, it is exposed that a pergola can not be considered a Local Equipment according to the regulations.

Therefore, to comply with the Decree of the City of Murcia that forced the Board of Landowners to rebuild Oliver Mill's house, and that this can also be used for equipment, as determined by the PGOU, the action must be to rebuild the walls and the roof that was demolished in 2008 as they were before said demolition, where the heraldic shield that this Mill looked on its façade for centuries would be placed again;

and this in order that when the planned planning is developed, the mill becomes a Local Equipment.

Doing something else, we understand from now Murcia would be committing a fraud of law and could be considered an embezzlement of public money.
