Change Murcia asks the City Council to study the recovery of public goods unregistered by the Church (25/09/2018)

The councilman of Cambiemos Murcia Sergio Ramos has submitted a motion to the plenary on Thursday by requesting the City Council to ask the Land Registry the list of immovable property registered by the Church in the municipality and initiate appropriate legal action for recovery of those whose public ownership may correspond to the local Administration.

The initiative, promoted by the Laica Europe association in many municipalities of the country, explains in its statement of reasons that the modification of the Mortgage Regulation promoted by the government of José María Aznar in 1998 allowed the Church to inscribe worship temples in his name, something that it was not possible before when dealing with goods outside commerce and of public nature.

The ecclesiastical hierarchy also revived two Francoist norms, unconstitutional since the beginning of democracy in Spain, which equated the Church with the public administration and the diocesan with the notaries, so that they could certify themselves - without giving any title - the property of those properties that until then were not registered in the Registry.

In Murcia, the Diocese has more than 470 properties for which IBI does not pay because they are dedicated to social functions, among which are the Cathedral of Murcia - inscribed in 2014 on behalf of the Church -;

the sanctuary of the Virgin of La Fuensanta and the Seminary -both registered two months ago- or the La Alberca cemetery. To these assets must be added those properties of the Church that are not intended for social purposes.

Ramos has insisted that the possible liturgical use of the property does not condition the property and that many have been built and restored with public money, and that most of them bear the public responsibility of their cultural and patrimonial tutelage.

It also consists, according to the mayor, the registration of thousands of cult goods in manifest abuse of law and fraud of law by the date of inmatriculación, before the 1998 reform;

for not having been owned by the Catholic Church, which includes lots, roads, gardens and squares, among others, and for not having documented their property in a reliable way.

The motion for municipal training has been approved with the backing of all the political formations represented in many municipalities and autonomous communities of the country, where some of the inscriptions have already been challenged and assets have been recovered for the public domain.

However, it is a "minimal part of the privatized patrimony", which, in the opinion of Ramos, requires the municipalities to continue working "against a registration amnesty that has meant subtracting from the heritage of all and many many assets of great importance historical ".

Laica Europe, in its exercise of gathering information from the lists of registrations throughout the country, has announced that it will proceed to report cases where it is believed that there are irregularities, as has already been done in many places, Zaragoza, Asturias or Cordoba.
