Huerta Viva: "The Old Bridge stops being BIC" (21/08/2018)

The association Huerta Viva has filed an appeal to the General Directorate of Cultural Property requesting that the deadline be extended to resolve the BIC declaration or that the file be reopened.

Given the historical and architectural importance of the Old Bridge, on February 26, 2015 the Platform for the Defense of the Cultural Heritage of Murcia submitted a request to declare it well of cultural interest with the category of monument, so that it received maximum protection and recognition granted by the Cultural Heritage Law of the Region of Murcia.

On July 29 of the same year the General Directorate of Cultural Property opened the declaration procedure, but had to modify the protection environment due to the allegations presented by the interested parties and the consultative entities that requested an extension of the environment that included the Plaza de Camachos

According to the Law of Cultural Heritage, the maximum term to resolve the declaration procedure of a cultural interest property with the category of monument is two years from the publication in the BORM, so that on August 13, 2017 it expired the procedure thus archiving all the proceedings.

Almost a year later, on August 1, 2018, it was when the Director General of Cultural Assets issued the resolution declaring the procedure to be expired, communicating it to the Murcia City Council and interested parties.

This morning the association Huerta Viva, integrated in the Platform in Defense of the Cultural Heritage of Murcia, has filed a motion for appeal asking about the extraordinary delay in the signature of the expiration resolution by the Director General, and why it has accepted the two years when the Law of Cultural Heritage in its article 18.3 allows the extension of the term to solve and notify, and more when of all the procedure was only the publication of the resolution of declaration of BIC.

Huerta Viva has also requested that, in the event that the period can not be extended for well-founded reasons, the General Directorate of Cultural Assets will once again initiate the declaration procedure on the proposal of the General Directorate itself, or on the initiative of Huerta Viva based on the documentation presented in February 2015.
