Now Murcia asks the court to require culture reports issued on the impossibility of legalization of the UCAM (11/07/2018)

The conclusion of the technical reports is that you can not legalize the works to have failed to comply with the Cultural Heritage Act of the Region of Murcia

The works would have been carried out knowing that they did not comply with the protection of the environment of the monument, besides that the on-site reconstruction of the Corralazo is pending

Now Murcia has gone to the Court of Instruction to process the complaint of this training for the buildings in the protected environment of the monument of the Monastery of Jerónimos, requesting in a letter required to the Ministry of Culture all reports written so far on these works and also the ones written on the attempt of legalization of the unlicensed aularios and other constructions to the south of the monastery.

This is the court number 5 of instruction in Murcia, where AM is accused as an accusation, since it was his denouncement of the facts that started the investigation regarding the UCAM.

In the submitted document it is requested that the General Directorate of Cultural Assets of the Autonomous Community be sent for the purpose of requiring the court to submit the files, and mainly the four reports issued by the aforementioned General Directorate regarding the four unfavorable cases to the UCAM processed: one against the Special Plan approved to build in Los Jerónimos Monastery;

the second relative to the sanctions for the demolition of the Corralazo;

a third in which reference was made to the buildings of the UCAM that currently have an open cause for alleged illegality;

and a room in which he was against the request of the Catholic university to consider their supposedly illegal buildings as 'social interest', and thus avoid a possible demolition.

The municipal training, which is located in the files processed by the Directorate General of Cultural Heritage in its Historical Heritage Service, has been able to witness the harsh conclusions of these technical reports drafted by the regional administration, carried out by experts in different cultural fields, administrative, landscape and architectural.

As you can read in them, it is impossible to legalize the works carried out by the UCAM in the protected environment of the Jerónimos Monastery, given the maximum legal protection held by this BIC and its perimeter zone.

Likewise, the reports highlight the impact caused by the constructions carried out in this monumental environment, where numerous unlicensed buildings have been accumulated, which UCAM is now trying to legalize through an exceptional planning authorization file, but for which there is no previous report Culture that authorized them when they were built.

From Now Murcia also highlights the citations to the Corralazo that are made in the Culture reports.

This century-old construction, which was demolished several years ago, is still pending reconstruction after the disciplinary proceedings against which it was destroyed, in the area north of the Monastery of Los Jerónimos.

The historical construction, linked to the rural exploitation that was carried out in the area, dominated the lands where the UCAM intends to expand towards the north, but it must be rebuilt in situ before any other work.

For all these reasons, Murcia has now decided to request the Court of Instruction to require all these reports to Culture, so that they can be added to the judicial file that investigates the constructions and works carried out in Los Jerónimos and so that the Justice can count on all the reports and documents that attest to the reality of what happened in this environment.

On the other hand, now Murcia has already shown in the municipal plenary of June that the excuse that the PP have been offering not to act against the situation of the UCAM of the existence of a process of legalization is just a hoax , since such procedure has been dismissed by administrative silence after the four months established in the Law for the Autonomous Community to finalize an essential procedure for such authorization, and without which it is not possible for the City Council to legalize anything.

In addition, this process involves obtaining a favorable report from the General Directorate of Cultural Property on the facilities built without permission at the foot of the Monastery of Los Jerónimos, a report that is known to have been prepared by the technicians and is not favorable .

This results in the dismissal due to administrative silence of the request for legalization requested by the UCAM and processed by the City of Murcia, plus the existence of the UNFAVORABLE report issued by the technicians of the General Directorate of Cultural Property, regarding the authorization by public interest of the facilities of the UCAM, as well as the other three reports issued by the same technicians, and also unfavorable, should be brought to the knowledge of the court that processes the criminal proceedings opened by these illegal buildings, and from Now Murcia that is what that is requested, for being of justice and essential for the resolution of a case that is already more than three years behind with excuses that can no longer be allowed.
