The Court rejects appeal against the award Latbus of the tram line 1 (06/08/2011)

The decision of the Court of Administrative Litigation Murcia No. 5 states that the Governing Board acted lawfully

The agreement for awarding the design, construction and operation of the tram line 1 was conducted in compliance with all legal precepts.

Well understood by the Court of Administrative Litigation # 5 of Murcia, which has rejected an appeal by Passenger Transport Murcia SL (Latbus) against approval.

The ruling rejects one by one all the aspects raised by the urban transport operating company to request the annulment of the resolutions adopted by the Governing Board for approval both of the specifications for the concession agreement -24 September 2008 - to contest the final award of April 2009 -1 -.

The legal arguments contained in the court ruling stated that:

· Without a doubt, Latbus "had by the City Council awarded the exclusive shuttle service for people in the town of Murcia, as it was only in relation to bus transport", where half of the tram different transport.

Therefore not be interpreted that both agreements involving "violence to the regime of exclusivity in the provision of transport services" and not be contested that the City "to begin the process proceed to establish a new urban transport system in the municipality as is the tram. "

• The Latbus viable or not will depend on many factors, "but that this will condition the government on how to establish various forms of transportation."

• Also is possible that the granting of the concession of the tramway has seriously affected the economic and financial balance of the grant of bus transportation.

• Although not involved Latbus as bidders in the bidding contest to the tram, remember that if the ruling was in business with companies who went to join the concessionaire.

"Hence, it is the less flashy, the judge continues to come into question precisely the technical and economic solvency of the companies that are going to be in society."

Also described as "paradoxical" that had taken part in the tender stage and that further experimental procedures for incorporation of the offers presented.

° to the alleged lack of coordination between the City and the Autonomous Region for Latbus alleged in his appeal, the decision considers that "should not be overlooked that the Autonomous Region reported favorably on the draft of the tram."
