The Mayor of Murcia, José Ballesta, today transferred to the Council of Spokespersons of the City Council the report prepared by the Legal Services in which he requests a second opinion from the State Agency for Railway Safety, so that the passage at the level of Santiago the Mayor, making possible the transit of people and vehicles while the works of the burial of the tracks are executed and until technically possible.

In its brief, the City Council transferred to the State Agency of Railway Safety that "the factual and legal requirements that allow its authorization meet" and urges the state agency to review the report of last September 20, in which it does not authorize the maintenance of such level crossing.

"In the case of Santiago el Mayor, this is a level crossing that is located at a short distance from the Carmen Station, in the case of a reduced speed section for trains.

Such circumstance constitutes an essential element to be considered for the purposes of the possibility of provisional authorization of that step at the level ".

In the brief it is argued that "there are justified and exceptional causes that allow provisional authorization for their maintenance".

"When deciding on the guarantee of permeability, it can not be the same a level crossing located on the outskirts that one located in an important way of the city located in the urban nucleus," he says.

"In the case of the crossing of Santiago el Mayor, there is also the existence of an important and legitimate neighborhood claim, and that on a permanent basis it is demanding from its authorities that the necessary and adequate connection between the districts of the city separated by the railway, and that this one does not interrupt abruptly while the works of burial are carried out ".

"In view of the arguments set forth," the letter concludes, "we request a review of the decision issued, since we understand that there are justified grounds for authorizing the maintenance of the passage at Santiago el Mayor level, on an exceptional and provisional basis, for the duration of the works of the burial and until technically possible to be maintained in function of such works.
