Murcia will have an ordinance that will allow to act specifically against irregular valet parking (30/07/2019)

The Department of Citizen Security and Economic Management works on the draft of the new regulations that seeks that all people can freely develop their activities of free movement, leisure and recreation with full respect for the dignity and rights of others.

Local Police and Social Services will inform offenders of existing social inclusion grants

The Department of Public Safety and Economic Management, directed by Eduardo Martínez-Oliva, has prepared the draft ordinance regulating activities or behaviors in the public space of the municipality of Murcia.

"In an effort to meet the needs that our neighbors demand from us on a day-to-day basis and provide adequate legal tools to establish the correct legal security framework for all the actions of this administration, we have prepared the text of this new regulation" , said Martínez-Oliva.

The purpose of this ordinance is to safeguard the right of citizens to transit through the municipality "without being disturbed or disturbed against their will and guarantee the free movement of persons and the protection of minors," explained the councilor.

In this way, it is intended to avoid any coercive or harassing practice on the public highway, which is intentionally preventing the free transit of citizens through public spaces and any offer of goods or services to people who are inside their vehicles, such as windshield cleaning, offering objects and unclaimed valet parking activities.

These behaviors will be pursued as follows:

- Requiring voluntary withdrawal and informing of social resources

- Denouncing if they persist in their attitude and do not abandon, which would entail an economic sanction.

- Possibility of referring to the judicial authority for violation of the law, in this case for disobedience.

The slight infraction will be a penalty of 750 euros, the serious one, 751 to 1,500 euros and the very serious one of 1,501 to 3,000 euros.

The City Council will inform, by both agents of authority and by the Social Services, of the aid for social inclusion existing to all those who exercise the behaviors established by this ordinance.

The main novelty of this regulation is that, in any case, Local Police agents will confiscate the means used to develop their unlawful behaviors, as well as the benefits obtained from the realization of these practices, including money.

Thus, seized assets will be deposited at the disposal of the competent police authority.

Once a final resolution has been issued and two months have elapsed without the owner having recovered the object, it will be destroyed or delivered free of charge to non-profit entities for social purposes.

The councilor explained that "currently, and for lack of specific regulations, you can only resort to the Road Safety Law so it is necessary that, within the regulatory capacity of local corporations, we have a specific ordinance that protects police actions and establishes prohibited conduct and its sanctioning regime. "

To prepare this draft, different existing ordinances or drafts of other cities such as Alicante, Barcelona, ​​Burgos, Valencia, Madrid or Seville have been studied but, above all, the model ordinance developed by the Spanish Federation of Municipalities and Provinces has been taken into account.

Thus, the text is currently pending the report of the Legal Services.

According to forecasts, the draft regulations will be taken to the Plenary session next September for initial approval, after which they will be publicly exposed for 30 days.

Once the suggestions are resolved, they will be taken back to Plenary so that, if it is finally approved, it will enter into force before the end of the year.
