Now Murcia: "The request to legalize the illegal works of the UCAM would be rejected by administrative silence" (28/06/2018)

-The municipal group has addressed councilor Navarro Corchón to certify the "rejection of the exceptional authorization to have met the deadline for processing without resolving, which determines the denial of the request of the UCAM"

-The Autonomous Community of the Region of Murcia has not authorized the legalization of buildings, so it is understood that the request is rejected after the legal deadline is exhausted

- Now Murcia will also send various documentation to the court that processes the case of the 8 buildings that are kept without an activity license, including the request for the certification of the rejection of the legalization of the buildings through exceptional authorization

-The PP, with the Mayor's vote of quality in a second vote, rejects the motion for his team to be held accountable for the situation of the UCAM.

The councilors of the PP who have been professors of the UCAM have not abstained in the voting.

NOW MURCIA today registered a request to the City of Murcia urging him to recognize the dismissal of the legalization of the buildings requested by the UCAM, having exhausted the deadline for the processing of it.

It was necessary to approve the file that the Autonomous Community of the Region of Murcia issued the authorization requested by the City Council, but the deadline for it has been exhausted, largely exceeding it without the CARM having informed or authorized the constructions.

That is why this municipal group has required that, in compliance with the law, the corresponding "CERTIFICATION OF ACT ALLEGED IN A DESCRIBED SENSE" be issued, which means recognizing that the deadline for processing has expired and, as indicated in the legal provision , "the passage of the maximum term established without resolving, determines the denial of the authorization".

From the PP, the councilor Navarro Corchón, has repeatedly shielded himself in that the illegalities in which the UCAM incurs were going away to solve with an open procedure for its legalization by means of "exceptional authorization for reasons of public interest", that had to grant the CARM after the review of the file submitted by the City Council.

As this municipal group now claims, "since the 4 month processing period that the CARM had for granting the exceptional authorization is exhausted, it is understood that the request has been rejected, since it was not expressly granted in time".

The City Council sent the file to the CARM on October 28, 2016, so that the elapsed time has been one and a half years, exceeding in more than one year the maximum legal term to issue the authorization.

For this reason, Murcia now urge Councilor Navarro Corchón to "stop inventing excuses and comply with the law, recognizing that the time for the supposed legalization has ended and now it is time to recognize the rejection of what the UCAM intended", as well as that "to finish with the barbarity of giving administrative cover to the UCAM", that without any respect to the norms and by way of the accomplished facts, has constructed a surface of thousands of meters in the monumental surroundings of the Monastery of the Jerónimos, with highly protected values.

Finally, and in reference to the motion that has been discussed this afternoon at the Plenary Session of the City of Murcia, the proposal of Ahora Murcia has been debated so that the PP government team would be accountable for the situation of the UCAM.

After an intense debate, where the councilor Angeles Micol has announced the request for certification of the dismissal for silence of the UCLA legalization, the proposal for accountability of the Town Planning Councilor and the PP government team has been rejected.

A second vote has been necessary before the tie produced in the voting, and Mayor José Ballesta has used his vote of quality to prevent approval of the motion.

Now Murcia has urged the PP councilors who have been professors of the UCAM or who have charged this private entity to abstain from participating in the vote, which they have not done in the end.
