Huermur tomb in the TSJ another macro urban plan in full huerta of Murcia (17/03/2019)

This housing development, the size of seven football fields, lacked, among other requirements, the corresponding water resources report required by the Water Law, for which reason it was appealed by Huermur before the Superior Court of Justice of Murcia in the 2011, result declared illegal by the Justice this week

Huermur points out the defense 'a coat and a sword' that the City of Murcia has made this urban plan in court, which has proved illegal, while the mayor Ballesta was proclaiming that his Town Hall and municipal government defended the garden, and the traditional landscape

The Association for the Conservation of the Garden and the Heritage of Murcia (Huermur) has managed to be declared illegal by the High Court of Justice of Murcia, a very discussed urban plan that sought the urbanization and destruction of more than 70,000 square meters of land of orchard, in the middle of the hamlet of Aljucer.

In particular the Partial Plan ZM-Ac1, planned to build hundreds of houses on valuable fertile soils of orchard, and destroy three channels of irrigation ditches of traditional irrigation, among which was an important stretch to the natural one of the thousand-year-old main ditch of Alquibla or Barreras .

These important ditches conserve centenary channels, already defined centuries ago by scholars like Rafael de Mancha, who in 1836 made a description of the Huerta and the ditches where we can go visiting some of these points, such as the meanders of the Alguazas canal, in the middle of this partial plan in Aljucer.

Huermur points out that this urbanization of homes, the size of seven football fields, lacked, among other important requirements, the necessary and mandatory report of water resources for its construction, which should have been issued by the Segura Hydrographic Confederation.

This reason is why finally, and after a decade of work both administratively in the City of Murcia, and judicial before the TSJ, this urban plan has been declared illegal and annulled by the Justice this week.

In the same sense, Huermur criticizes the shameful attitude of the City of Murcia, which has defended 'a coat and a sword' this partial plan in the courts while the mayor Ballesta, directly responsible for the Legal Services of the Consistory, was telling Murcia The City Council and its PP Government Team protect and defend Murcia's orchard and its cultural and natural values.

An attitude, remarked from Huermur, which has been compromised to be declared illegal the aforementioned urban plan that both defended the local entity, and intended to devour seven hectares of our garden.

This has been highlighted by the President of Huermur, Sergio Pacheco, noting that: "During the long judicial procedure in the TSJ we had to face some municipal legal services that were determined to save this aberration of urban plan, while we saw the mayor and the councilman of Urbanism were taking photos and propaganda with the Week of the Huerta, the acequias and saying that the City is the first to defend the garden, "adding that" finally has had to come justice to overthrow and declare illegal another plan urbanistic more, that threatened our garden and its historical, cultural and natural values ".

Finally, Huermur warns the City of Murcia that it will not hesitate to appeal to the Justice any urban or municipal action that is suspected to threaten the garden of Murcia, its environment or the rich historical, cultural and landscape it houses.

Noting that along with this plan now annulled in Aljucer are already several that Huermur has thrown to justice for breaches of sectoral legislation such as water, environment, cultural heritage etc, just remember the Point 100 modification of the PGOU in the district Sucina and the 87 in the Raal.

Also from Huermur it is pointed out that there are several judicial proceedings in progress similar to the one annulled this week, and that this sentence of the Supreme Court supposes the beginning of the end for the profusion of PGOU that Murcia has in force today.

A centennial olmeda object of various fires and damages

Among the ditches that intended to destroy this illegal plan, there is a centennial fountain that seems to be a magnet for bad luck.

Since the approval of the urban plan by the City Council, in recent summers has suffered two serious fires, as well as an attempt to fell, which was paralyzed by Huermur activists and neighbors, who alerted the Local Police of these events, paralyzing the destruction of this woodland protected.

The elms are included in the Decree of the "Regional Catalog of Protected Wild Flora of the Region of Murcia", and already motivated a first modification of the urban plan as soon as it was approved, since the City Council had to recognize that the approved documentation did not include these elms , indicating in its place that the lands of the zone were of "scrub / wasteland", in spite of the great span of the trunks and the height of the elm trees "ulmus minor" existing in the zone.
